1. Eligibility

You must be at least eighteen (18) years of age and have reached the age of majority in your jurisdiction to access or use the Platform.

By creating an account, you represent and warrant that:

• You are at least 18 years old.
• All information you provide is accurate.
• You are legally capable of entering into binding agreements.
• You will comply with all applicable laws.

The Company reserves the right to require age and identity verification at any time.

Third-Party Age Verification

To help ensure compliance with age-restricted content requirements, Hazy Content LLC utilizes Yoti as a third-party age and identity verification service.

Access to certain portions of the Platform, including Creator onboarding, content publishing, subscriber access, account recovery, and other restricted features, may require successful completion of age or identity verification through Yoti or another verification provider designated by the Company.

Users acknowledge and agree that:

• Verification services are performed by independent third-party providers.
• Hazy Content LLC may transmit personal information and verification-related information to Yoti as necessary to facilitate verification.
• Verification outcomes may be used by Hazy Content LLC to approve, deny, restrict, suspend, or terminate access to Platform features.
• Hazy Content LLC is not responsible for errors, delays, outages, or independent decisions made by third-party verification providers.

Successful verification does not guarantee access to the Platform or approval of any account.

The Company reserves the right to require re-verification at any time.

2. Nature of the Platform

Hazy Content is a custom-built online creator subscription platform owned and operated by Hazy Content LLC.

The Platform enables verified independent creators to publish, distribute, and monetize original digital content directly to subscribers.

Creators may monetize their content through:

• Monthly recurring subscriptions;
• One-time premium content purchases;
• Voluntary tips from subscribers; and
• Additional monetization features that may be introduced by the Company.

Creators are solely responsible for the content they publish and represent and warrant that all content uploaded to the Platform complies with applicable laws, these Terms of Service, the Creator Agreement, the Community Guidelines, and all other applicable Platform policies. While some creators may publish adult-oriented material, the Platform also permits non-explicit content, including but not limited to modeling, fitness, photography, education, lifestyle, cosplay, entertainment, art, and other creator-focused digital media.

Hazy Content LLC provides the technology platform through which creators distribute content to subscribers. Payment transactions are securely processed by (Name of Payment Processor). Hazy Content LLC does not directly process, store, or retain users' payment card information.

All products offered through the Platform are digital and are delivered electronically. Hazy Content does not sell, manufacture, warehouse, or ship physical products.

3. Account Registration

Users must maintain accurate account information.

You are responsible for all activity occurring under your account and for safeguarding your login credentials.

We may suspend or terminate accounts for security, compliance, legal, or policy reasons.

4. Creator Verification

Creators must complete identity verification and any age-verification procedures required by the Company.

Creators represent and warrant that:

• They are at least 18 years old.
• They own or control all rights necessary to publish content.
• All individuals appearing in content are at least 18 years old.
• All individuals appearing in content have provided informed consent.

Creators also must successfully complete the Company's identity, age, tax, and payment verification procedures before publishing content or receiving payouts.

Creators may be required to provide:

• Full legal name
• Date of birth
• Residential address
• Verified email address
• Government-issued photo identification
• A standalone selfie photograph
• A selfie photograph holding the submitted government-issued identification next to the Creator's face
• Banking information necessary for payout processing
• Tax documentation required by applicable law

Creators located in the United States must additionally provide:

• A completed IRS Form W-9
• A valid Social Security Number or Taxpayer Identification Number

The Company may require additional information or re-verification at any time.

Failure to complete verification may result in denial of Creator status, suspension, withholding of payouts, or termination of the account.

Submission of verification information does not guarantee approval as a Creator.

The Company may request documentation supporting these representations at any time.

Third-Party Age Verification

To help ensure compliance with age-restricted content requirements, Hazy Content LLC utilizes Yoti as a third-party age and identity verification service.

Access to certain portions of the Platform, including Creator onboarding, content publishing, subscriber access, account recovery, and other restricted features, may require successful completion of age or identity verification through Yoti or another verification provider designated by the Company.

Users acknowledge and agree that:

• Verification services are performed by independent third-party providers.
• Hazy Content LLC may transmit personal information and verification-related information to Yoti as necessary to facilitate verification.
• Verification outcomes may be used by Hazy Content LLC to approve, deny, restrict, suspend, or terminate access to Platform features.
• Hazy Content LLC is not responsible for errors, delays, outages, or independent decisions made by third-party verification providers.

Successful verification does not guarantee access to the Platform or approval of any account.

The Company reserves the right to require re-verification at any time.

5. Prohibited Content

Hazy Content LLC permits verified adult creators to publish lawful digital content through the Platform. However, to protect users, comply with applicable laws, satisfy payment processor requirements, comply with the operating regulations of payment card networks, and maintain the integrity of the Platform, certain content and activities are strictly prohibited.

Creators are solely responsible for ensuring that all content they create, upload, publish, stream, transmit, distribute, sell, promote, or otherwise make available through the Platform complies with these Terms, the Creator Agreement, the Community Guidelines, the AI Content Policy, the Adult Content Policy, the Performer Consent & Age Recordkeeping Policy, the DMCA/Copyright Policy, the Complaints & Content Removal Policy, the Appeals Policy, and all applicable laws.

The following categories of content are strictly prohibited and may not be uploaded, published, transmitted, sold, streamed, promoted, or otherwise distributed through the Platform.

A. Child Exploitation and Minors

Content that:

• depicts, involves, promotes, or sexualizes any person under eighteen (18) years of age;
• depicts a person who appears to be under eighteen (18), regardless of stated age;
• depicts simulated minors or computer-generated minors in sexual situations;
• contains child sexual abuse material (CSAM);
• promotes child exploitation or grooming;
• depicts age-play where prohibited by applicable law or payment network requirements;
• attempts to circumvent age verification requirements.

B. Non-Consensual Content

Content that:

• depicts or promotes sexual activity without voluntary, informed consent;
• depicts rape or sexual assault;
• depicts coercion, force, threats, intimidation, blackmail, or exploitation;
• depicts sleeping, unconscious, drugged, intoxicated, hypnotized, incapacitated, or otherwise non-consenting individuals in sexual situations;
• uses any person's image, likeness, voice, or identity without documented authorization;
• has been reported by a depicted individual as lacking valid consent;
• violates the AI Consent Policy or Performer Consent & Age Recordkeeping Policy.

C. Identity, Consent, and Performer Documentation

Content for which the Creator cannot demonstrate, upon request:

• that every depicted individual is at least eighteen (18) years of age;
• valid government-issued proof of age;
• written consent to participate in the creation of the content;
• written consent for public distribution of the content through Hazy Content LLC;
• written consent for download rights where downloadable content is enabled;
• any additional documentation required by applicable law, payment processors, payment card networks, or Platform policies.

D. Deepfakes and Synthetic Media

Content that:

• depicts an identifiable individual through AI-generated, synthetic, manipulated, altered, or deepfake media without that person's documented consent;
• impersonates another individual;
• falsely represents that a person participated in content they did not actually create;
• utilizes face swapping, voice cloning, digital impersonation, or similar technologies without proper authorization;
• violates the AI Content Policy or AI Labeling Policy.

Lawfully created AI-generated content may only be published if it fully complies with all Platform policies, is properly disclosed where required, and satisfies applicable legal and payment processor requirements.

E. Violence and Exploitation

Content depicting or promoting:

• murder;
• torture;
• kidnapping;
• human trafficking;
• forced labor;
• excessive violence;
• fantasy snuff;
• dismemberment;
• mutilation;
• serious bodily harm;
• sexual violence;
• abuse;
• coercion;
• criminal exploitation.

F. Bestiality and Other Prohibited Sexual Content

Content depicting or promoting:

• bestiality;
• sexual acts involving animals;
• animal cruelty;
• incest where prohibited by applicable law;
• necrophilia;
• prostitution or escort services where prohibited by law;
• sexual activity involving coercion or exploitation;
• sexual activity involving minors;
• sexual activity involving unconscious or incapacitated individuals.

G. Illegal Activity

Content that:

• promotes or facilitates criminal activity;
• provides instructions for committing crimes;
• promotes terrorism or violent extremism;
• promotes money laundering;
• promotes human trafficking;
• facilitates fraud or financial crime;
• promotes identity theft;
• promotes hacking or unauthorized access;
• promotes creation or distribution of malware;
• promotes illegal weapons manufacturing;
• promotes explosives or bomb-making;
• facilitates unlawful conduct.

H. Drugs and Controlled Substances

Content primarily promoting:

• unlawful drug manufacturing;
• unlawful drug trafficking;
• unlawful sale or distribution of controlled substances;
• criminal drug activity.

Nothing in this section prohibits lawful educational, documentary, or news-related discussions where otherwise permitted by Platform policies.

I. Intellectual Property Violations

Content that infringes or misappropriates:

• copyrights;
• trademarks;
• patents;
• trade secrets;
• publicity rights;
• privacy rights;
• contractual rights;
• proprietary rights;
• or any other intellectual property rights.

Creators must own or possess all rights necessary to publish their content.

J. Fraud and Deceptive Practices

Content or conduct involving:

• scams;
• phishing;
• impersonation;
• deceptive advertising;
• knowingly false descriptions of paid content;
• fraudulent payment activity;
• account fraud;
• manipulation of subscriptions or transactions;
• fake engagement;
• fake verification;
• or any other deceptive practice.

K. Malware and Platform Security

Content that:

• contains malicious software;
• distributes malware, ransomware, spyware, or viruses;
• attempts unauthorized access to systems;
• interferes with Platform security;
• attempts to circumvent moderation systems;
• interferes with payment processing or verification systems.

L. Hate Speech and Harassment

Content that:

• unlawfully incites violence;
• unlawfully promotes hatred against protected groups;
• constitutes unlawful discriminatory harassment;
• threatens individuals or groups;
• encourages targeted abuse;
• violates applicable hate speech laws.

M. Payment Processor and Card Network Prohibited Content

Content prohibited by Hazy Content LLC's payment processors or applicable payment card networks, including content prohibited by their operating regulations, compliance standards, or risk management requirements, is prohibited on the Platform even where such content may otherwise be lawful.

N. Other Prohibited Content

Any content that:

• violates these Terms;
• violates any Platform policy;
• violates applicable law;
• exposes Hazy Content LLC to unreasonable legal, regulatory, financial, operational, or reputational risk;
• interferes with Platform operations;
• undermines Platform safety or security;
• is determined by Hazy Content LLC, acting reasonably and in good faith, to be inconsistent with the intended purpose of the Platform.

Enforcement

All uploaded content is subject to Hazy Content LLC's mandatory pre-publication screening process, including AI-assisted screening and, where applicable, review by human moderators before publication.

If content is reasonably believed to violate these Terms, applicable law, payment processor requirements, or any Platform policy, Hazy Content LLC may, in its sole discretion:

• refuse publication;
• remove or disable access to content;
• require modification of content;
• request additional documentation;
• suspend or terminate creator privileges;
• suspend or terminate user accounts;
• restrict monetization;
• withhold or delay payouts where permitted by applicable law or contractual agreement;
• preserve records for compliance or investigative purposes;
• report suspected unlawful activity to payment processors, regulatory authorities, or law enforcement agencies; and
• take any other action authorized by these Terms, applicable law, or Platform policies.

The categories of prohibited content described in this section are intended to be illustrative and not exhaustive. Hazy Content LLC reserves the right to prohibit additional content or conduct where reasonably necessary to protect users, comply with legal or contractual obligations, satisfy payment processor or payment card network requirements, maintain Platform integrity, or reduce legal, financial, operational, or security risks.

6. 18 U.S.C. §2257 Compliance

Creators are required to comply with Hazy Content LLC's 18 U.S.C. §2257 Compliance Policy, which is incorporated into these Terms by reference.

By applying for or maintaining a Creator account, Creators represent and warrant that they will maintain any records required by applicable law and will provide such documentation to Hazy Content LLC upon request for compliance, moderation, payment processor, or legal purposes.

Failure to comply with the Company's 2257 Compliance Policy or to provide requested documentation may result in content removal, suspension of payouts, suspension of the Creator account, or permanent termination.

7. Content Ownership

Hazy Content LLC does not claim ownership of original content created and uploaded by verified Creators. Except for the limited rights expressly granted to Hazy Content LLC under these Terms and any other applicable agreements, Creators retain all ownership rights, including all copyrights, trademarks, publicity rights, and other intellectual property rights, in and to the original content they lawfully create and publish through the Platform.

Creator Ownership

Subject to these Terms of Service, the Creator Agreement, and applicable law, each Creator represents and warrants that they own or otherwise possess all rights, licenses, permissions, authorizations, and legal authority necessary to upload, publish, distribute, monetize, and license the content made available through the Platform.

Creators remain solely responsible for:

• the legality of their content;
• obtaining all required permissions and licenses;
• obtaining and maintaining valid written consent from every person depicted in their content;
• maintaining proof-of-age documentation where required;
• ensuring that all content complies with applicable laws, payment processor requirements, payment card network standards, and Platform policies; and
• resolving any disputes relating to ownership or intellectual property rights.

License Granted to Hazy Content LLC

By uploading, publishing, transmitting, streaming, messaging, storing, or otherwise making content available through the Platform, the Creator grants Hazy Content LLC a worldwide, non-exclusive, royalty-free, sublicensable (only where reasonably necessary to operate the Platform), transferable solely in connection with a merger, acquisition, sale of assets, or corporate reorganization, license to:

• host;
• store;
• reproduce;
• cache;
• process;
• encode;
• transcode;
• convert file formats;
• display;
• publicly perform;
• publicly display;
• transmit;
• distribute through the Platform;
• stream;
• deliver;
• index;
• archive;
• back up;
• moderate;
• review;
• analyze;
• scan using automated technologies;
• publish to authorized subscribers;
• generate thumbnails, previews, and promotional images;
• create technical copies necessary for content delivery;
• detect fraud, piracy, or policy violations;
• preserve evidence for legal or compliance purposes; and
• otherwise use the content solely as reasonably necessary to operate, maintain, improve, secure, promote, administer, and provide the Platform and its services.

This license exists solely to enable Hazy Content LLC to operate the Platform and does not transfer ownership of the Creator's intellectual property to Hazy Content LLC.

Promotional Use

Unless otherwise prohibited by applicable law or a separate written agreement with the Creator, the Creator grants Hazy Content LLC permission to use the Creator's publicly available username, display name, profile image, creator biography, publicly visible preview images, publicly visible promotional videos, and other publicly available promotional materials solely for purposes of:

• operating the Platform;
• advertising the Platform;
• promoting the Creator;
• marketing Hazy Content LLC;
• social media promotion;
• search engine optimization;
• press releases;
• investor or business presentations;
• educational materials regarding the Platform; and
• other legitimate business purposes relating to the operation and promotion of Hazy Content LLC.

Hazy Content LLC will not publicly disclose subscriber-only content for promotional purposes without the Creator's authorization unless otherwise permitted by these Terms or required by applicable law.

Platform Rights

The Creator acknowledges and agrees that Hazy Content LLC may:

• review content before publication;
• utilize automated technologies, including artificial intelligence, to screen content for compliance;
• remove, restrict, disable, or refuse publication of content;
• modify technical characteristics of uploaded files, including compression, resizing, transcoding, and formatting;
• apply watermarks or other security measures;
• generate preview images or thumbnails;
• preserve copies of content for legal, compliance, security, backup, disaster recovery, fraud prevention, payment processor requirements, or evidentiary purposes;
• temporarily disable access during investigations;
• permanently remove content that violates Platform policies or applicable law; and
• retain copies where required by law, court order, payment processor requirements, regulatory obligations, or legitimate business interests.

These operational rights do not transfer ownership of the underlying intellectual property to Hazy Content LLC.

Intellectual Property

Creators retain ownership of their copyrights and other intellectual property rights except to the extent licenses are expressly granted under these Terms.

Subscribers receive only a limited license to access content pursuant to the Subscriber License section of these Terms and acquire no ownership interest in any creator content.

Nothing in these Terms transfers ownership of:

• copyrights;
• trademarks;
• service marks;
• trade dress;
• trade secrets;
• patents;
• publicity rights;
• privacy rights;
• domain names;
• software;
• source code;
• databases; or
• other intellectual property belonging to Hazy Content LLC, Creators, or other rights holders.

AI and Automated Technologies

Creators acknowledge that uploaded content may be analyzed using automated technologies, including artificial intelligence and machine learning systems, solely for purposes including:

• moderation;
• fraud detection;
• prohibited content detection;
• duplicate content detection;
• copyright enforcement;
• security;
• spam prevention;
• payment processor compliance;
• legal compliance; and
• operation of the Platform.

Except as expressly authorized by these Terms or with the Creator's separate consent where required by applicable law, Hazy Content LLC does not claim ownership of Creator content for the purpose of training publicly available generative artificial intelligence models.

Removal of Content

Creators may remove content from public availability through Platform functionality where permitted by these Terms and the Creator Agreement.

However, the Creator acknowledges that Hazy Content LLC may continue to retain copies of removed content where reasonably necessary for:

• legal compliance;
• regulatory obligations;
• payment processor requirements;
• fraud prevention;
• dispute resolution;
• chargeback investigations;
• intellectual property investigations;
• enforcement of Platform policies;
• law enforcement requests;
• backup systems; or
• legitimate business purposes permitted by applicable law.

Representations and Warranties

By publishing content on the Platform, the Creator represents and warrants that:

• the Creator owns or lawfully controls all rights necessary to publish the content;
• all persons depicted have provided valid written consent;
• all persons depicted are at least eighteen (18) years of age;
• the content does not violate any applicable law;
• the content does not infringe the rights of any third party;
• all required records are maintained and will be provided upon lawful request; and
• publication of the content does not violate these Terms or any Platform policy.

Reservation of Rights

All rights not expressly granted under these Terms remain reserved by Hazy Content LLC, the applicable Creator, or the respective intellectual property owner.

Nothing contained in these Terms shall be interpreted as creating a partnership, joint ownership, assignment of copyright, or transfer of intellectual property rights between Hazy Content LLC and any user except as expressly stated herein.

8. Subscriber License

Subject to these Terms of Service, successful payment of all applicable fees, continued compliance with all Platform policies, and any additional terms established by the applicable Creator, Hazy Content LLC grants subscribers a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to access and view digital content lawfully made available to them through the Platform.

This license grants only the right to access and privately view purchased or subscribed content through authorized features of the Platform. No ownership interest, copyright, intellectual property right, or other proprietary interest in any content is transferred to the subscriber.

Personal Use Only

Content purchased, unlocked, subscribed to, streamed, viewed, or otherwise accessed through the Platform is licensed solely for the subscriber's personal, private, and non-commercial use.

Subscribers may not use creator content for any commercial purpose without the Creator's prior written consent and any additional authorization required by Hazy Content LLC.

Ownership of Content

All intellectual property rights in creator content remain owned by the applicable Creator or other lawful rights holder.

Nothing contained in these Terms, the Platform, or any transaction shall be interpreted as transferring ownership of any copyright, trademark, publicity right, privacy right, or other intellectual property right to a subscriber.

Hazy Content LLC does not acquire ownership of creator content solely by hosting or distributing such content through the Platform.

License Restrictions

Except where expressly authorized by Hazy Content LLC or the applicable Creator, subscribers shall not directly or indirectly:

• copy, reproduce, duplicate, or archive creator content;
• download content except where downloading is expressly enabled by the Platform and authorized by the Creator;
• record livestreams, video streams, audio streams, or other live broadcasts;
• capture screenshots or screen recordings for redistribution or commercial use;
• redistribute, publish, repost, upload, broadcast, stream, transmit, display, or otherwise make creator content available to any third party;
• sell, license, rent, lease, sublicense, assign, gift, or otherwise transfer access to creator content;
• upload creator content to other websites, applications, file-sharing services, social media platforms, messaging platforms, forums, cloud storage services, or any other medium;
• create derivative works based upon creator content;
• edit, manipulate, modify, alter, crop, enhance, or transform creator content without authorization;
• remove, obscure, alter, or circumvent any copyright notice, watermark, branding, metadata, security feature, digital rights management technology, or other proprietary notice;
• use creator content to train, develop, improve, evaluate, or operate artificial intelligence systems, machine learning models, image generators, video generators, voice cloning systems, facial recognition systems, or similar technologies;
• scrape, harvest, collect, index, or systematically extract creator content or Platform data through automated or manual means;
• circumvent technological protection measures or Platform security controls;
• attempt to access content without proper authorization or payment; or
• otherwise exploit creator content in any manner inconsistent with these Terms or applicable law.

Account Sharing

Subscriptions and purchased access are licensed solely to the registered subscriber.

Subscribers may not:

• share login credentials;
• permit another individual to access their account;
• transfer subscriptions to another person;
• permit simultaneous unauthorized access to the Platform; or
• otherwise circumvent subscription or access controls.

Subscribers are responsible for all activity occurring under their account.

Unauthorized Distribution

Subscribers acknowledge that unauthorized copying, downloading, recording, redistribution, or publication of creator content may violate copyright laws, publicity rights, privacy rights, contractual rights, and other applicable laws.

Hazy Content LLC and affected Creators reserve all rights available under applicable law to investigate, pursue, and enforce claims arising from unauthorized distribution or misuse of creator content.

Such enforcement may include:

• suspension or termination of Platform accounts;
• permanent revocation of access to purchased content;
• removal of unauthorized content;
• DMCA takedown notices;
• preservation of evidence;
• cooperation with payment processors, hosting providers, internet service providers, and law enforcement agencies;
• civil litigation; and
• any other remedies available under applicable law.

Platform Security

Subscribers agree not to interfere with the operation or security of the Platform or any creator's content, including by attempting to:

• bypass subscription requirements;
• circumvent payment systems;
• defeat digital rights management technologies;
• interfere with content delivery systems;
• exploit software vulnerabilities;
• reverse engineer Platform security features; or
• engage in unauthorized automated access.

Creator Availability

Subscribers acknowledge that creator content may become unavailable due to content removal, moderation decisions, legal requirements, creator account suspension, creator account termination, intellectual property disputes, payment processor requirements, technical issues, or other circumstances.

Hazy Content LLC does not guarantee the continued availability of any particular creator, subscription, message, livestream, or item of digital content.

Violations

Violation of this Subscriber License or any related Platform policy may result in one or more enforcement actions, including:

• removal of access to content;
• suspension or termination of subscriptions;
• suspension or termination of Platform accounts;
• forfeiture of previously purchased access where permitted by applicable law;
• denial of future access to the Platform;
• civil legal action;
• referral to law enforcement authorities where appropriate; and
• any other remedies available under these Terms or applicable law.

Reservation of Rights

All rights not expressly granted under this Subscriber License are reserved by Hazy Content LLC, the applicable Creator, and all other lawful rights holders.

This Subscriber License automatically terminates upon termination of a subscriber's account, expiration or cancellation of applicable subscriptions, violation of these Terms, or any other event resulting in termination of the subscriber's right to access the Platform.

9. Payment Processing

All payments made through Hazy Content are securely processed by (Name of Payment Processor).

By making a purchase, you authorize (Name of Payment Processor) and Hazy Content LLC to process applicable charges for subscriptions, premium content purchases, voluntary tips, taxes, processing fees, and other authorized transactions.

Payment information is collected and processed by (Name of Payment Processor) in accordance with its own privacy policy, terms of service, and applicable financial regulations. Hazy Content LLC does not store complete payment card information on its own systems.

Hazy Content LLC reserves the right to suspend, delay, reverse, refuse, or cancel transactions where necessary to investigate fraud, comply with applicable law, satisfy payment processor requirements, resolve disputes, or enforce Platform policies.

Transaction Limits

To promote fraud prevention, payment security, and compliance with payment processor requirements, Hazy Content LLC establishes minimum and maximum transaction amounts.

At launch:

• Minimum transaction amount: $9.99 USD
• Maximum transaction amount: $99.99 USD

These limits apply to subscriptions, premium content purchases, and voluntary tips unless otherwise determined by the Company.

Prices may change at any time.

Subscriptions automatically renew until canceled.

10. Creator Payouts

Creator payouts are governed by the applicable Creator Agreement. Subject to the terms of that Agreement, eligible Creators receive eighty percent (80%) of eligible subscription revenue, and Hazy Content retains a twenty percent (20%) platform fee.

Creator payouts and Annual Creator Bonuses are subject to, among other things:

• Chargebacks;
• Refunds;
• Payment reversals;
• Fraud investigations;
• Compliance reviews;
• Payment processor requirements; and
• Applicable legal or regulatory obligations.

Hazy Content may delay, withhold, reserve, adjust, or reverse Creator payouts or Annual Creator Bonuses where reasonably necessary to investigate fraud, address payment disputes or chargebacks, comply with applicable law, satisfy payment processor requirements, enforce these Terms or the Creator Agreement, or protect the Platform or its users.

11. Refund Policy

All products and services offered through Hazy Content are digital in nature and are delivered electronically immediately following successful payment processing through (Name of Payment Processor).

Because digital content cannot be returned once access has been granted, all purchases are final unless otherwise required by applicable law or expressly provided in this Refund Policy.

No physical products are sold or shipped through the Platform.

Unless otherwise required by law, all purchases are final.

Refunds may be granted at the Company's sole discretion in cases involving:

• Billing errors;
• Unauthorized transactions;
• Technical failures.

Chargeback abuse may result in account termination.

12. Copyright Complaints

Hazy Content LLC respects the intellectual property rights of copyright owners, creators, artists, performers, photographers, videographers, writers, and other rights holders. Users are prohibited from uploading, publishing, distributing, transmitting, streaming, selling, or otherwise making available any content that infringes the copyright or other intellectual property rights of any person or entity.

Creators are solely responsible for ensuring that they own or have obtained all rights, licenses, permissions, authorizations, and legal authority necessary to publish their content through the Platform.

Reporting Copyright Infringement

If you believe that material available through the Platform infringes your copyright or other intellectual property rights, you may submit a written copyright infringement notice to Hazy Content LLC using the contact information below.

Notices should include sufficient information to allow Hazy Content LLC to reasonably investigate the claim, including, where applicable:

• identification of the copyrighted work claimed to have been infringed;
• identification of the allegedly infringing material, including its location on the Platform;
• sufficient information to enable Hazy Content LLC to locate the material;
• your full legal name and contact information;
• a statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or applicable law;
• a statement that the information contained in the notice is accurate; and
• a statement, made under penalty of perjury where required by applicable law, that you are the copyright owner or are authorized to act on behalf of the copyright owner.

Copyright notices may be submitted to:

Investigation

Upon receipt of a facially valid copyright complaint, Hazy Content LLC may, in its sole discretion and to the fullest extent permitted by applicable law:

• review the complaint;
• request additional documentation from any party;
• temporarily disable access to the challenged content;
• prevent publication of pending content;
• preserve relevant evidence and account records;
• notify the affected Creator;
• request proof of ownership, licensing, authorization, or other supporting documentation;
• communicate with the complaining party and the affected Creator;
• cooperate with legal counsel, payment processors, hosting providers, or law enforcement where appropriate; and
• take any other action reasonably necessary to investigate the claim.

Counter-Notification

If content has been removed or disabled because of an alleged copyright infringement, the affected Creator may submit a counter-notification where permitted by applicable law.

A counter-notification should include sufficient information to allow Hazy Content LLC to evaluate the request, including any documentation demonstrating ownership, licensing, authorization, or another lawful basis for publication of the content.

Submission of a counter-notification does not guarantee restoration of content.

Hazy Content LLC reserves the right to maintain removal of content where required by law, court order, payment processor requirements, legal obligations, or where the Company reasonably determines continued removal is appropriate.

Repeat Infringer Policy

Hazy Content LLC maintains a policy for addressing repeat copyright infringement.

Users who repeatedly upload or attempt to upload infringing content may be subject to one or more enforcement actions, including:

• removal of infringing content;
• refusal to publish future content;
• temporary suspension of publishing privileges;
• suspension of monetization features;
• withholding of creator payouts where permitted by applicable law or contractual agreement;
• permanent account suspension;
• permanent account termination; and
• any other action authorized by these Terms or applicable law.

The determination of whether a user is a repeat infringer shall be made by Hazy Content LLC in good faith based upon the circumstances of each case.

False or Fraudulent Claims

Submitting knowingly false, fraudulent, misleading, or bad-faith copyright complaints or counter-notifications may result in:

• rejection of the submission;
• suspension or termination of Platform accounts;
• loss of Platform privileges;
• liability under applicable law; and
• any other remedies available to Hazy Content LLC or affected parties.

Record Retention

Hazy Content LLC may preserve notices, counter-notices, correspondence, account records, moderation records, verification records, content copies, and other relevant information for legal compliance, dispute resolution, litigation, payment processor requirements, regulatory obligations, fraud prevention, or other legitimate business purposes.

No Determination of Ownership

Hazy Content LLC functions as an online platform and does not act as a court of law.

Except where required by applicable law, nothing in Hazy Content LLC's investigation, moderation decisions, or enforcement actions shall be interpreted as a legal determination regarding copyright ownership, authorship, licensing, fair use, infringement, or the ultimate merits of any intellectual property dispute.

Reservation of Rights

Hazy Content LLC reserves the right to remove, restrict, disable, refuse publication of, or otherwise take action regarding any content that is reasonably believed to infringe intellectual property rights or otherwise violate these Terms, the DMCA/Copyright Policy, applicable law, payment processor requirements, or Platform policies.

Users are encouraged to review the Platform's separate DMCA/Copyright Policy, which provides additional procedures governing copyright complaints, counter-notifications, repeat infringement, and related intellectual property matters.

13. Content Moderation

Hazy Content LLC is committed to maintaining a safe, lawful, and compliant platform for creators, subscribers, and visitors. To protect users, comply with applicable laws, satisfy payment network requirements, and enforce Platform policies, Hazy Content LLC actively moderates content and user activity.

The Company reserves the right, but does not undertake the obligation, to review, monitor, investigate, moderate, restrict, refuse, remove, disable access to, or otherwise take action regarding any content, account, communication, transaction, or activity on the Platform at any time, with or without prior notice, where permitted by applicable law.

Content moderation is conducted to identify and address content or conduct that may violate applicable laws, these Terms, the Community Guidelines, the Creator Agreement, the Adult Content Policy, the AI Content Policy, the Performer Consent & Age Recordkeeping Policy, the Complaints & Content Removal Policy, the Appeals Policy, the DMCA/Copyright Policy, payment processor requirements, payment card network standards, or any other Platform policy.

Moderation activities may include, but are not limited to:

• reviewing user-uploaded content before publication;
• reviewing content reported by users, rights holders, payment processors, or governmental authorities;
• investigating complaints alleging unlawful or prohibited content;
• reviewing suspected copyright, trademark, publicity, or privacy rights violations;
• reviewing suspected non-consensual content or unauthorized use of an individual's image, likeness, or voice;
• reviewing suspected AI-generated, synthetic, or deepfake content;
• reviewing account activity for fraud, impersonation, deceptive practices, spam, or other abuse;
• reviewing compliance with performer verification, proof-of-age, consent, and recordkeeping requirements;
• investigating suspected violations of applicable law or Platform policies; and
• preserving evidence where reasonably necessary for compliance, legal obligations, or investigations.

Prohibited Content Categories

The Platform permits lawful adult content created and published by verified adult creators. However, Hazy Content LLC strictly prohibits content or conduct that violates applicable law, Platform policies, or payment network standards, including, but not limited to:

• content involving or depicting minors or simulated minors;
• child sexual abuse material;
• non-consensual sexual content;
• sexual assault, rape, coercion, exploitation, or abuse;
• content depicting sleeping, unconscious, incapacitated, drugged, hypnotized, or otherwise non-consenting individuals in sexual situations;
• human trafficking or forced labor;
• bestiality or animal cruelty;
• incest where prohibited by applicable law;
• excessive violence, torture, murder, kidnapping, or fantasy snuff content;
• prostitution or escort services where prohibited by law;
• illegal drug manufacturing or promotion of criminal activity;
• fraud, scams, phishing, identity theft, money laundering, or other deceptive practices;
• hate speech, extremist content, or unlawful discriminatory content;
• copyrighted, trademarked, or otherwise protected material published without authorization;
• unauthorized use of another person's image, likeness, voice, or identity;
• AI-generated, AI-assisted, or synthetic content that violates the AI Content Policy;
• deepfakes, face swaps, voice cloning, or other synthetic media depicting identifiable individuals without documented authorization and consent;
• malware, ransomware, spyware, malicious software, or content intended to compromise the security of users or the Platform;
• content that violates payment processor requirements or the operating regulations of Visa, Mastercard, Discover, American Express, or other payment card networks; and
• any other content or conduct prohibited by applicable law or Platform policies.

AI-Assisted Moderation

Hazy Content LLC may utilize automated technologies, including artificial intelligence, machine learning, automated detection systems, and fraud prevention technologies, to assist in identifying content or activity that may require review. Such technologies are used as investigative and screening tools and may assist in detecting potential violations of law, Platform policies, intellectual property rights, payment network requirements, fraud prevention standards, or security obligations.

Except where immediate automated action is necessary to protect the Platform, comply with applicable law, or satisfy payment processor or payment network requirements, enforcement decisions affecting publication, removal, suspension, or termination are made following review by qualified human moderators.

Where Hazy Content LLC reasonably believes that content or user activity may violate applicable law or Platform policies, the Company may, in its sole discretion:

• refuse publication of content;
• remove or disable access to content;
• restrict visibility of content;
• require additional documentation, verification, proof-of-age records, performer consent documentation, or ownership documentation;
• request modifications to content;
• disable downloads, purchases, subscriptions, or monetization;
• issue warnings;
• temporarily suspend creator privileges;
• suspend or terminate user accounts;
• withhold, delay, reverse, or permanently deny payouts where permitted by applicable law or contractual agreement;
• preserve records for legal, compliance, investigative, or evidentiary purposes;
• cooperate with payment processors, financial institutions, regulatory authorities, rights holders, or law enforcement agencies; and
• take any other action reasonably necessary to protect users, enforce Platform policies, or comply with legal obligations.

Users acknowledge and agree that Hazy Content LLC retains sole discretion in determining whether content complies with the Platform's policies and applicable law, subject to any appeal rights expressly provided under the Platform's Appeals Policy, Complaints & Content Removal Policy, or applicable law.

Nothing in this section shall be interpreted as creating an obligation for Hazy Content LLC to monitor every item of content, communication, transaction, or user activity. Users remain solely responsible for the legality, accuracy, authenticity, ownership, and compliance of all content they create, upload, publish, distribute, or otherwise make available through the Platform.

14. Pre-Publication Content Screening

To promote a safe, lawful, and compliant Platform, all user-uploaded content is subject to mandatory review before it is published or made available to subscribers or other users. No content submitted by a Creator will be publicly displayed until it has successfully completed Hazy Content LLC's pre-publication screening process.

As part of this process, Hazy Content LLC utilizes automated screening technologies, including artificial intelligence ("AI"), to assist in identifying content that may violate applicable laws, payment network requirements, these Terms, or any other Platform policy.

AI-assisted screening is designed to identify, among other things, content that may:

• violate applicable local, state, federal, national, or international laws;
• depict or otherwise involve minors or simulated minors;
• depict child sexual abuse material or the exploitation of minors;
• depict or promote non-consensual sexual activity, sexual assault, coercion, abuse, or exploitation;
• depict sleeping, unconscious, incapacitated, or otherwise non-consenting individuals in sexual situations;
• depict or promote human trafficking, forced labor, or other exploitative conduct;
• depict or promote bestiality, animal cruelty, incest where prohibited by law, or other prohibited sexual content;
• depict excessive violence, torture, murder, kidnapping, or fantasy snuff content;
• infringe copyrights, trademarks, publicity rights, privacy rights, or other intellectual property rights;
• contain unauthorized use of another person's image, likeness, voice, or identity;
• contain prohibited AI-generated, synthetic, or deepfake content;
• contain fraud, scams, phishing, malware, deceptive practices, or unlawful activity;
• violate the Terms of Service, Community Guidelines, Creator Agreement, Adult Content Policy, AI Content Policy, Complaints & Content Removal Policy, Appeals Policy, Performer Consent & Age Recordkeeping Policy, DMCA/Copyright Policy, or any other Platform policy;
• violate the requirements or standards of the Company's payment processor or applicable payment card networks; or
• otherwise present legal, regulatory, security, or compliance concerns.

Content identified by automated screening as potentially violating applicable laws or Platform policies will not be published automatically. Instead, the content will be flagged for review by Hazy Content LLC's human moderation team.

Human moderators will review the flagged content and any relevant supporting information to determine whether the content complies with applicable laws, Platform policies, and payment network requirements.

Following review, Hazy Content LLC may, in its sole discretion:

• approve the content for publication;
• request additional information or documentation from the Creator;
• require the Creator to modify or remove the content;
• reject the content and prevent publication;
• temporarily or permanently restrict the Creator's ability to publish content;
• suspend or terminate the Creator's account;
• withhold or delay payouts where permitted by applicable law or the Creator Agreement;
• preserve relevant records for compliance or investigative purposes;
• report suspected unlawful activity to payment processors, regulatory authorities, or law enforcement agencies where required or permitted by applicable law; or
• take any other action authorized by these Terms or applicable law.

Creators whose content is rejected or removed will generally be notified of the reason for the decision, unless prohibited by law or where doing so could interfere with an investigation, regulatory requirement, or law enforcement matter.

Where applicable under the Platform's Appeals Policy or Complaints & Content Removal Policy, Creators may submit an appeal requesting review of a moderation decision. Appeals will be reviewed in accordance with the procedures set forth in those policies. Submission of an appeal does not guarantee publication of the content or reversal of the original moderation decision.

The use of AI-assisted screening is intended to support the Platform's moderation process. Final decisions regarding publication, removal, suspension, or other enforcement actions affecting user-uploaded content are made by human moderators, except where automated action is required to protect the Platform, comply with applicable law, or satisfy payment processor or payment network requirements.

15. Privacy

Your privacy is important to Hazy Content LLC. Our collection, use, storage, disclosure, retention, and protection of personal information are governed by our Privacy Policy, which is incorporated into these Terms by reference. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to the terms of our Privacy Policy.

In order to provide, maintain, secure, and improve the Platform, Hazy Content LLC may collect, process, store, transfer, and disclose personal information as described in the Privacy Policy and as otherwise permitted or required by applicable law. Such information may include, without limitation, account registration information, identity verification information, age verification information, payment-related information, tax documentation, communications, uploaded content, technical device information, usage data, cookies and similar technologies, IP addresses, security logs, and other information necessary to operate the Platform.

Hazy Content LLC utilizes third-party service providers to perform certain functions on our behalf, including but not limited to identity and age verification, payment processing, fraud prevention, cloud hosting, customer support, analytics, security monitoring, communications, and content moderation. By using the Platform, you acknowledge and agree that certain personal information may be shared with these third-party providers as reasonably necessary for them to perform services on behalf of Hazy Content LLC. Such providers include, but are not limited to, Yoti for identity and age verification and (Name of Payment Processor) for payment processing and fraud prevention.

As part of operating the Platform, Hazy Content LLC may utilize automated technologies, including artificial intelligence, machine learning systems, fraud detection tools, and automated content analysis technologies, to assist with content moderation, platform security, fraud detection, identity verification, spam prevention, policy enforcement, risk assessment, and compliance with applicable laws and payment network requirements. Such technologies are used to assist Hazy Content LLC in identifying potential violations requiring further review. Except where immediate automated action is necessary to protect the Platform or comply with applicable law, significant enforcement decisions affecting user accounts or content are subject to review by human moderators.

Creators acknowledge that personal information and documentation submitted during the creator verification process, including government-issued identification, proof-of-age documentation, tax documentation, banking information, performer consent documentation, and other compliance-related records, may be retained for the periods required by applicable law, regulatory obligations, payment processor requirements, fraud prevention purposes, contractual obligations, dispute resolution, and legitimate business interests.

Users acknowledge that communications with Hazy Content LLC, reports submitted through the Platform, complaints, appeals, customer support requests, moderation actions, investigations, and enforcement decisions may be recorded, retained, reviewed, and used for quality assurance, legal compliance, fraud prevention, security, dispute resolution, and enforcement of these Terms and other Platform policies.

Hazy Content LLC may preserve, access, review, and disclose personal information, user content, account records, communications, verification records, transaction information, and other information where the Company reasonably believes such action is necessary to: (a) comply with applicable laws, regulations, court orders, subpoenas, or lawful governmental requests; (b) protect the rights, property, or safety of Hazy Content LLC, its users, or third parties; (c) investigate suspected fraud, illegal activity, intellectual property infringement, or violations of these Terms or other Platform policies; (d) enforce contractual rights; (e) cooperate with payment processors, financial institutions, law enforcement agencies, regulatory authorities, or other governmental entities; or (f) protect the integrity, security, or operation of the Platform.

Because Hazy Content is operated from the United States and is available to users worldwide, personal information may be transferred to, processed in, and stored in the United States or other jurisdictions where Hazy Content LLC or its service providers maintain operations. By using the Platform, you acknowledge and consent to such transfers, subject to applicable law and the safeguards described in our Privacy Policy.

While Hazy Content LLC implements commercially reasonable administrative, technical, and physical safeguards designed to protect personal information, no method of electronic transmission, storage, or processing is completely secure. Accordingly, Hazy Content LLC cannot guarantee that unauthorized access, data breaches, interception, loss, alteration, or disclosure of information will never occur. Users are responsible for maintaining the confidentiality of their account credentials and for promptly notifying Hazy Content LLC of any suspected unauthorized access or security incident involving their account.

Users retain any privacy rights granted to them under applicable law. Information regarding the exercise of applicable privacy rights, including requests relating to access, correction, deletion, portability, restriction of processing, or other rights where available, is set forth in the Hazy Content Privacy Policy.

Your continued access to or use of the Platform constitutes your acknowledgment of, and agreement to, Hazy Content LLC's collection, use, processing, disclosure, retention, and protection of personal information as described in these Terms and in the Privacy Policy.

16. Disclaimer of Warranties

THE PLATFORM, INCLUDING ALL CONTENT, FEATURES, FUNCTIONALITY, SOFTWARE, TECHNOLOGY, APPLICATIONS, SERVICES, COMMUNICATIONS, MATERIALS, INFORMATION, AND OTHER COMPONENTS PROVIDED BY HAZY CONTENT LLC, IS PROVIDED ON AN "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HAZY CONTENT LLC, ITS AFFILIATES, OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SERVICE PROVIDERS, AND BUSINESS PARTNERS EXPRESSLY DISCLAIM ALL WARRANTIES, REPRESENTATIONS, GUARANTEES, AND CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WITHOUT LIMITING THE FOREGOING, HAZY CONTENT LLC EXPRESSLY DISCLAIMS ANY IMPLIED WARRANTIES OF:

• merchantability;
• fitness for a particular purpose;
• title;
• non-infringement;
• quiet enjoyment;
• uninterrupted access;
• uninterrupted availability;
• system integration;
• compatibility;
• security;
• reliability;
• accuracy;
• completeness; and
• freedom from defects, viruses, malware, or other harmful components.

Platform Warranties

Hazy Content LLC does not warrant or represent that:

• the Platform will operate continuously, without interruption, delay, or error;
• the Platform will always be available at any particular time or location;
• any defects, bugs, vulnerabilities, or errors will be identified or corrected;
• the Platform will be compatible with every device, browser, operating system, or third-party service;
• communications transmitted through the Platform will always be secure or confidential;
• data loss will never occur;
• unauthorized access to accounts or systems will never occur;
• the Platform will satisfy every user's expectations or intended purposes; or
• use of the Platform will produce any particular financial, commercial, personal, or other result.

Creator Content

Hazy Content LLC does not create, produce, direct, script, supervise, edit, endorse, verify, guarantee, or warrant the accuracy, legality, authenticity, quality, safety, completeness, reliability, or suitability of user-generated content published by creators. All creator content represents the views, expressions, and activities of the applicable creator and not those of Hazy Content LLC.

Company Representations

The Company makes no representations or warranties regarding:

• the identity, reputation, qualifications, conduct, or reliability of any creator or subscriber;
• the availability, quality, value, or accuracy of creator content;
• whether creator content will meet a subscriber's expectations;
• the accuracy of descriptions, advertisements, previews, thumbnails, or promotional materials published by creators;
• the availability of any creator or subscription;
• the commercial success of creators using the Platform; or
• the earnings, revenue, profitability, or financial performance that any creator may achieve.

AI, Automated Technologies, and Third-Party Services

Although Hazy Content LLC maintains content moderation procedures, creator verification processes, identity verification requirements, performer consent requirements, proof-of-age requirements, complaints procedures, appeals procedures, and AI-assisted moderation technologies, the Company does not warrant that every item of content, communication, transaction, or user activity will be reviewed, identified, prevented, removed, or determined to comply with applicable law or Platform policies before or after publication.

Hazy Content LLC may utilize automated technologies, including artificial intelligence, machine learning systems, automated detection tools, and other technological processes, to assist with content moderation, fraud detection, security, and policy enforcement. The Company makes no warranty regarding the accuracy, completeness, reliability, or effectiveness of such technologies, and users acknowledge that automated systems may incorrectly identify, flag, restrict, approve, or fail to identify content or activity.

The Platform may integrate with or rely upon third-party products and services, including identity verification providers, payment processors, cloud hosting providers, communications providers, analytics services, fraud prevention services, and other service providers. Hazy Content LLC makes no warranty regarding the availability, security, accuracy, performance, or reliability of any third-party products or services and disclaims responsibility for failures, interruptions, delays, errors, or decisions attributable to such third parties.

Payment Processing and Platform Availability

Hazy Content LLC does not warrant that any payment submitted through the Platform will be successfully processed, that any payout will occur within a particular timeframe, or that any transaction will be free from chargebacks, fraud investigations, payment processor reviews, banking delays, or regulatory requirements.

Users acknowledge that access to the Platform may be suspended, interrupted, restricted, modified, or terminated at any time due to scheduled maintenance, emergency maintenance, software updates, security incidents, technical failures, network outages, legal obligations, payment processor requirements, fraud prevention measures, governmental action, or circumstances beyond the reasonable control of Hazy Content LLC.

User Responsibilities

Users are solely responsible for:

• their use of the Platform;
• the legality of their activities;
• maintaining backup copies of any content they upload;
• protecting their account credentials;
• evaluating the suitability of creator content;
• complying with applicable laws; and
• exercising appropriate judgment when interacting with other users.

Miscellaneous

No advice, information, statement, communication, marketing material, or representation made by Hazy Content LLC or its representatives, whether oral, written, electronic, or otherwise, shall create any warranty unless expressly stated in a written agreement signed by an authorized representative of Hazy Content LLC.

Some jurisdictions do not permit the exclusion of certain warranties. Accordingly, certain portions of this Disclaimer of Warranties may not apply to particular users to the extent prohibited by applicable law. In such jurisdictions, this section shall be enforced to the maximum extent permitted by applicable law.

This Disclaimer of Warranties is intended to apply to the fullest extent permitted by applicable law and shall survive the suspension or termination of any account, these Terms, or the user's relationship with Hazy Content LLC.

17. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HAZY CONTENT LLC, ITS AFFILIATES, OWNERS, MEMBERS, MANAGERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, SERVICE PROVIDERS, PAYMENT PROCESSORS, AND OTHER BUSINESS PARTNERS SHALL NOT BE LIABLE FOR ANY LOSS, DAMAGE, CLAIM, LIABILITY, COST, OR EXPENSE ARISING OUT OF OR RELATED TO THE PLATFORM, THESE TERMS, OR YOUR USE OF OR INABILITY TO USE THE PLATFORM, EXCEPT TO THE EXTENT LIABILITY CANNOT BE EXCLUDED UNDER APPLICABLE LAW.

Without limiting the foregoing, Hazy Content LLC shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including, without limitation:

• loss of profits;
• loss of revenue;
• loss of earnings;
• loss of business opportunities;
• loss of anticipated savings;
• loss of subscriptions or subscribers;
• loss of customers or audience;
• reputational harm;
• emotional distress;
• personal inconvenience;
• loss of goodwill;
• business interruption;
• loss of data;
• corruption or destruction of data;
• loss of digital content;
• unauthorized access to accounts;
• identity theft;
• payment disputes;
• chargebacks;
• banking delays;
• payment processor actions;
• tax liabilities;
• legal expenses;
• regulatory penalties;
• or any other indirect, incidental, consequential, special, or punitive damages, whether arising in contract, tort (including negligence), strict liability, statute, or otherwise, even if Hazy Content LLC has been advised of the possibility of such damages.

Creator Content

Hazy Content LLC is a technology platform that hosts and facilitates the distribution of user-generated content. The Company does not create, produce, direct, supervise, edit, or control creator content and is not responsible for the legality, accuracy, authenticity, quality, completeness, safety, availability, reliability, or suitability of any content published by creators.

User Content Liability

Hazy Content LLC shall not be liable for:

• content created, uploaded, streamed, transmitted, or distributed by creators;
• statements, representations, advertisements, previews, thumbnails, or promotional materials created by creators;
• the conduct, actions, omissions, or behavior of creators, subscribers, or other users;
• disputes between users;
• transactions between creators and subscribers except as expressly provided in these Terms;
• dissatisfaction with purchased content;
• inaccurate or misleading creator profiles or descriptions;
• creator inactivity, account suspension, or account termination;
• the removal, restriction, demonetization, or moderation of creator content;
• unauthorized redistribution, copying, downloading, recording, or piracy of creator content by third parties;
• infringement of intellectual property rights by users;
• violations of privacy or publicity rights committed by users; or
• any acts or omissions of third parties.

AI, Third-Party Services, and Moderation

Although Hazy Content LLC implements identity verification procedures, performer verification requirements, proof-of-age requirements, consent documentation requirements, AI-assisted moderation, human moderation, fraud detection measures, complaints procedures, appeals procedures, and other compliance controls, the Company does not guarantee that unlawful, fraudulent, infringing, deceptive, harmful, or otherwise prohibited content or activity will be identified, prevented, or removed before or after publication.

Hazy Content LLC may utilize automated technologies, including artificial intelligence and machine learning systems, to assist with content moderation, fraud prevention, security monitoring, and policy enforcement. The Company shall not be liable for any loss or damage arising from the operation, limitations, accuracy, or decisions of such automated technologies, including content being incorrectly approved, rejected, flagged, delayed, removed, restricted, or otherwise affected.

Hazy Content LLC shall not be liable for interruptions, delays, outages, failures, or damages arising from:

• internet service providers;
• telecommunications providers;
• cloud hosting providers;
• content delivery networks;
• payment processors;
• identity verification providers;
• financial institutions;
• software vendors;
• cybersecurity incidents;
• malicious attacks;
• force majeure events;
• governmental actions;
• regulatory requirements;
• acts of third parties; or
• any circumstance beyond the reasonable control of Hazy Content LLC.

The Company shall not be liable for delays, holds, reversals, chargebacks, reserves, payout suspensions, account freezes, transaction declines, payment processor investigations, banking delays, fraud investigations, tax withholding obligations, or other actions taken by (Name of Payment Processor), financial institutions, card networks, regulatory authorities, or governmental agencies.

Hazy Content LLC reserves the right to moderate, restrict, refuse publication of, remove, disable access to, suspend, investigate, preserve, or report content or user activity as provided in these Terms and other Platform policies. The Company shall not be liable for any damages arising from good-faith moderation decisions, enforcement actions, content removal, account restrictions, account suspensions, account terminations, or compliance measures undertaken to satisfy applicable law, payment processor requirements, or Platform policies.

Assumption of Risk

Users acknowledge that they assume all risks associated with using the Platform, interacting with other users, purchasing or publishing creator content, relying upon creator representations, transmitting information electronically, and participating in online transactions.

Limitation of Liability

To the fullest extent permitted by applicable law, the total cumulative liability of Hazy Content LLC arising out of or relating to the Platform, these Terms, or any related claim shall not exceed the greater of:

• (a) the total amount actually paid by the user to Hazy Content LLC through the Platform during the twelve (12) months immediately preceding the event giving rise to the claim; or
• (b) one hundred United States dollars (US $100.00).

Survival and Savings Clause

The limitations, exclusions, and disclaimers contained in this section apply regardless of the legal theory under which a claim is brought, including contract, tort (including negligence), strict liability, statute, equity, or otherwise, and shall survive the suspension or termination of these Terms, any user account, or the user's relationship with Hazy Content LLC.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law. Where applicable law prohibits a particular limitation of liability, such limitation shall apply only to the maximum extent permitted by law, and the remainder of this section shall remain in full force and effect.

18. Indemnification

You agree to defend, indemnify, and hold harmless Hazy Content LLC, its affiliates, parent companies, subsidiaries, successors, assigns, owners, members, managers, officers, directors, employees, contractors, agents, licensors, service providers, payment processors, business partners, and their respective representatives (collectively, the "Indemnified Parties") from and against any and all claims, demands, actions, causes of action, investigations, proceedings, lawsuits, liabilities, judgments, damages, losses, fines, penalties, settlements, costs, expenses, and reasonable attorneys' fees arising out of or relating to:

• your access to or use of the Platform;
• your violation of these Terms or any other Platform policy;
• your violation of any applicable local, state, federal, national, or international law, regulation, or governmental requirement;
• any content you create, upload, publish, stream, transmit, distribute, sell, license, promote, or otherwise make available through the Platform;
• any allegation that your content infringes, misappropriates, or otherwise violates any copyright, trademark, patent, trade secret, publicity right, privacy right, contractual right, or other intellectual property or proprietary right of any person or entity;
• any allegation that your content was published without the required consent, authorization, or legal authority;
• any claim involving a person's image, likeness, voice, name, biometric information, or identity appearing in your content without valid authorization;
• any claim relating to AI-generated, AI-assisted, synthetic, manipulated, or deepfake content that you create, upload, publish, or distribute;
• any false, misleading, deceptive, or fraudulent statements, advertisements, descriptions, previews, thumbnails, or promotional materials that you publish or use in connection with your content;
• your failure to obtain, maintain, or produce legally required proof-of-age documentation, performer consent forms, model releases, identity verification records, or other documentation required by applicable law, payment processor requirements, or Platform policies;
• your violation of the Creator Agreement, Community Guidelines, Adult Content Policy, AI Content Policy, Performer Consent & Age Recordkeeping Policy, Complaints & Content Removal Policy, Appeals Policy, DMCA/Copyright Policy, Privacy Policy, or any other Platform policy;
• any payment dispute, chargeback, fraudulent transaction, unauthorized transaction, refund request, tax obligation, or financial loss arising from your use of the Platform;
• your misuse of another user's account, credentials, or personal information;
• your interactions, communications, or disputes with other users;
• your negligence, intentional misconduct, fraud, or criminal conduct; or
• any act or omission by you that results in legal, regulatory, contractual, financial, or reputational harm to any of the Indemnified Parties.

Creator-Specific Indemnification

Where you are a Creator, your indemnification obligations additionally include any claim, investigation, enforcement action, or liability arising from:

• the legality of your content;
• the commercial distribution of your content;
• the participation of any performer appearing in your content;
• the accuracy of your creator profile or content descriptions;
• your eligibility to monetize content through the Platform;
• your compliance with performer age verification and consent requirements;
• your compliance with applicable recordkeeping obligations;
• your compliance with payment processor requirements, payment card network standards, or applicable industry regulations.

Defense of Claims

Hazy Content LLC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. In such event, you agree to fully cooperate with Hazy Content LLC in the defense, investigation, settlement, or resolution of the matter, including providing documents, information, testimony, and other reasonable assistance upon request.

Settlement of Claims

You shall not settle any claim subject to indemnification without the prior written consent of Hazy Content LLC if the proposed settlement would impose any obligation, admission of liability, restriction, or other adverse effect upon any Indemnified Party.

Survival

The indemnification obligations set forth in this section are independent of your other obligations under these Terms and shall apply regardless of whether a claim arises before, during, or after termination of your account or these Terms.

The rights and remedies provided in this section are cumulative and in addition to any other rights or remedies available to Hazy Content LLC under these Terms, the Creator Agreement, applicable law, or in equity.

Savings Clause

Nothing in this section shall require a user to indemnify Hazy Content LLC to the extent such indemnification is prohibited by applicable law. Where any portion of this section is determined to be unenforceable under applicable law, it shall be enforced to the maximum extent permitted, and the remaining provisions shall remain in full force and effect.

19. Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A DISPUTE DECIDED BY A JUDGE OR JURY.

Agreement to Arbitrate

To the fullest extent permitted by applicable law, you and Hazy Content LLC agree that any dispute, claim, controversy, or cause of action arising out of or relating to these Terms, the Platform, your account, any content, any transaction, any payment, any subscription, any creator payout, any moderation or enforcement decision, any communication with Hazy Content LLC, or your relationship with Hazy Content LLC shall be resolved exclusively through final and binding arbitration rather than in court, except as expressly provided in this section.

This agreement to arbitrate shall be interpreted broadly and applies to claims arising under contract, tort (including negligence), fraud, misrepresentation, statutory law, consumer protection law, equity, or any other legal theory.

Informal Resolution Requirement

Before initiating arbitration, the party seeking to bring a dispute agrees to first provide written notice describing the nature of the dispute, the relevant facts, the requested relief, and any supporting documentation reasonably necessary to evaluate the claim.

The parties agree to make a good-faith effort to resolve the dispute informally for a period of at least thirty (30) days following receipt of such notice before commencing arbitration, unless a longer period is required by applicable law.

Notices to Hazy Content LLC shall be sent to the legal contact information designated by the Company.

Arbitration Rules

If a dispute cannot be resolved through informal negotiations, the dispute shall be resolved by a single neutral arbitrator through binding arbitration administered by a nationally recognized arbitration organization selected by Hazy Content LLC, unless the parties mutually agree to another arbitration provider or applicable law requires otherwise.

The arbitration shall be conducted in accordance with the applicable rules of the arbitration provider in effect at the time arbitration is initiated, except where those rules conflict with these Terms or applicable law.

The arbitrator shall have exclusive authority to resolve all issues relating to the interpretation, enforceability, applicability, validity, formation, and scope of this arbitration agreement, including any claim that all or part of this arbitration provision is void or unenforceable.

Location of Arbitration

Unless otherwise required by applicable law or agreed by the parties, arbitration proceedings shall take place in Palm Beach County, Florida, United States.

Where appropriate and permitted by the arbitration provider, hearings may be conducted remotely by telephone, secure video conference, electronic submissions, or other mutually acceptable means.

Governing Law

The Federal Arbitration Act ("FAA") shall govern the interpretation and enforcement of this arbitration provision to the fullest extent permitted by applicable law. Except where preempted by federal law, the substantive laws specified in the Governing Law section of these Terms shall apply to the underlying dispute.

Arbitrator's Authority

The arbitrator may award only those remedies that would be available in an individual action under applicable law.

The arbitrator shall not have authority to:

• certify or hear any class, collective, representative, or consolidated proceeding;
• award relief for or against individuals who are not parties to the arbitration;
• modify or disregard these Terms except as required by applicable law;
• issue any ruling inconsistent with applicable law; or
• award punitive or exemplary damages where prohibited by these Terms or applicable law.

The arbitrator shall issue a written decision explaining the basis for the award.

Allocation of Fees

Each party shall initially bear its own attorneys' fees, expert fees, and other litigation expenses unless applicable law or the arbitrator determines otherwise.

Arbitration filing fees, administrative fees, and arbitrator compensation shall be allocated in accordance with the applicable arbitration rules unless otherwise required by applicable law.

Exceptions to Arbitration

Nothing in this section prevents either party from:

• filing an individual claim in a court having proper jurisdiction where arbitration cannot legally be required;
• seeking temporary, preliminary, or permanent injunctive relief to prevent unauthorized disclosure of confidential information, misuse of intellectual property, or other irreparable harm;
• pursuing claims relating to copyright, trademark, trade secret, patent, or other intellectual property rights where applicable law permits court proceedings;
• reporting suspected criminal activity or regulatory violations to governmental authorities;
• cooperating with law enforcement agencies or regulatory authorities; or
• exercising any non-waivable legal rights provided under applicable law.

International Users

Hazy Content LLC operates from the United States and provides services to users worldwide.

Users located outside the United States acknowledge that arbitration procedures, consumer rights, and enforcement mechanisms may differ from those available in their country of residence.

Nothing in this section is intended to deprive users of any mandatory consumer rights or legal protections that cannot be waived under the laws of their jurisdiction.

Where mandatory law prohibits enforcement of any portion of this arbitration agreement, that portion shall not apply to the extent required by law, while the remaining provisions shall remain enforceable to the fullest extent permitted.

Confidentiality

Unless prohibited by applicable law, the parties agree that all arbitration proceedings, evidence, testimony, filings, rulings, settlements, and awards shall remain confidential and shall not be disclosed to any third party except:

• as necessary to enforce or challenge an arbitration award;
• as required by law, court order, or governmental authority;
• to legal counsel, accountants, insurers, auditors, or other professional advisors bound by confidentiality obligations; or
• as otherwise agreed by the parties.

Survival

This arbitration agreement shall survive the suspension or termination of your account, the termination of these Terms, the completion of any transaction, or the end of your relationship with Hazy Content LLC.

If any portion of this Arbitration section is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by applicable law.

20. Class Action Waiver

Individual Resolution of Disputes

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU AND HAZY CONTENT LLC AGREE THAT ANY CLAIM, DISPUTE, CONTROVERSY, OR LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THE PLATFORM, THESE TERMS, YOUR ACCOUNT, YOUR CONTENT, ANY TRANSACTION, OR YOUR RELATIONSHIP WITH HAZY CONTENT LLC SHALL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF, CLAIMANT, CLASS MEMBER, REPRESENTATIVE, PRIVATE ATTORNEY GENERAL, OR PARTICIPANT IN ANY CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, MASS ACTION, REPRESENTATIVE ACTION, OR OTHER MULTI-PARTY PROCEEDING.

Waiver of Class and Representative Proceedings

You expressly waive, to the fullest extent permitted by applicable law, any right to:

• participate in a class action lawsuit;
• participate in a collective action;
• participate in a mass arbitration;
• participate in a consolidated arbitration;
• participate in a representative action;
• serve as a private attorney general on behalf of others;
• act as a class representative;
• recover damages or other relief on behalf of any other person or entity; or
• combine your claim with the claims of other users unless Hazy Content LLC expressly agrees in writing.

Each claim must be brought solely on behalf of the individual asserting the claim.

Separate Proceedings Required

Unless otherwise required by applicable law, disputes involving different users shall not be joined, consolidated, coordinated, or otherwise combined in a single arbitration or judicial proceeding.

The arbitrator or court shall have no authority to:

• certify a class action;
• consolidate claims involving multiple users;
• hear representative claims;
• award relief on behalf of individuals who are not parties to the proceeding; or
• conduct proceedings on any basis other than an individual basis.

Application to All Claims

This Class Action Waiver applies to every dispute arising out of or relating to:

• these Terms of Service;
• the Creator Agreement;
• the Privacy Policy;
• the Community Guidelines;
• the AI Content Policy;
• the Appeals Policy;
• the Complaints & Content Removal Policy;
• the Adult Content Policy;
• any transaction processed through the Platform;
• subscriptions;
• creator payouts;
• moderation decisions;
• account suspensions or terminations;
• intellectual property disputes;
• privacy-related claims;
• consumer protection claims;
• statutory claims;
• common law claims; and
• any other dispute relating to your use of the Platform or your relationship with Hazy Content LLC.

No Effect on Government Enforcement

Nothing in this section prevents any governmental authority, regulatory agency, or law enforcement organization from exercising its lawful authority or bringing any action authorized by applicable law.

Likewise, nothing in this section limits Hazy Content LLC's ability to cooperate with governmental authorities or regulatory agencies.

Severability

If any portion of this Class Action Waiver is determined by a court or arbitrator of competent jurisdiction to be invalid, unenforceable, or unlawful with respect to a particular claim or jurisdiction, that portion shall be severed only to the minimum extent necessary, and the remaining provisions shall remain valid and enforceable to the fullest extent permitted by applicable law.

If applicable law prohibits the waiver of a particular type of representative or class proceeding, such prohibition shall apply only to the extent required by law and only with respect to that specific claim or jurisdiction.

Survival

This Class Action Waiver shall survive the suspension or termination of your account, the termination of these Terms, the completion of any transaction, and the end of your relationship with Hazy Content LLC.

The provisions of this section are intended to be interpreted broadly and enforced to the fullest extent permitted by applicable law.

21. Governing Law

These Terms of Service, the Platform, all related Platform policies, and any dispute, claim, controversy, or cause of action arising out of or relating to the Platform, these Terms, your account, your use of the Platform, any transaction, subscription, purchase, creator payout, moderation decision, or your relationship with Hazy Content LLC shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of laws principles to the extent such principles would require the application of the laws of another jurisdiction.

For users located within the United States, the parties expressly agree that Florida law shall govern all matters arising from or relating to these Terms except where federal law preempts or otherwise controls.

For users located outside the United States, you acknowledge and agree that Hazy Content LLC operates the Platform from the United States and that your use of the Platform constitutes a voluntary decision to access services provided from the United States. You further acknowledge that the Platform is intended to be operated in accordance with applicable United States laws together with the laws specifically referenced in these Terms.

Nothing contained in these Terms shall be interpreted as depriving any consumer of mandatory rights or legal protections that cannot be waived under the laws of the jurisdiction in which that consumer resides. To the extent any mandatory consumer protection law or other non-waivable legal requirement applies notwithstanding this Governing Law provision, such law shall apply only to the minimum extent required by applicable law.

To the fullest extent permitted by applicable law, the parties agree that Florida law shall govern the interpretation, validity, construction, performance, enforcement, and remedies relating to these Terms and all related Platform policies, including but not limited to the:

• Creator Agreement;
• Privacy Policy;
• Community Guidelines;
• Adult Content Policy;
• AI Content Policy;
• Complaints & Content Removal Policy;
• Appeals Policy;
• DMCA/Copyright Policy;
• Performer Consent & Age Recordkeeping Policy;
• Cookie Policy; and
• any other policy incorporated into these Terms by reference.

Nothing in this section shall limit or restrict the application of the Federal Arbitration Act or any other applicable federal law where such law governs the interpretation or enforcement of these Terms, including the Arbitration section.

If any provision of this Governing Law section is determined by a court or arbitrator of competent jurisdiction to be invalid or unenforceable in a particular jurisdiction, that provision shall be enforced only to the extent permitted by applicable law, and the remaining provisions shall remain in full force and effect.

This Governing Law provision shall survive the suspension or termination of your account, the termination of these Terms, the completion of any transaction, and the end of your relationship with Hazy Content LLC.

22. Termination

Hazy Content LLC reserves the right, in its sole discretion and to the fullest extent permitted by applicable law, to suspend, restrict, limit, disable, or permanently terminate any account, access to the Platform, creator privileges, subscriber privileges, content, monetization features, or other Platform services at any time, with or without prior notice, where permitted by applicable law.

Grounds for Suspension or Termination

Without limiting any other rights available to Hazy Content LLC under these Terms or applicable law, the Company may suspend or terminate an account, refuse publication of content, remove content, restrict Platform functionality, or take any other enforcement action for reasons including, but not limited to:

• violation of these Terms of Service;
• violation of the Creator Agreement;
• violation of the Community Guidelines;
• violation of the Adult Content Policy;
• violation of the AI Content Policy;
• violation of the Appeals Policy;
• violation of the Complaints & Content Removal Policy;
• violation of the Performer Consent & Age Recordkeeping Policy;
• violation of the Privacy Policy;
• violation of the DMCA/Copyright Policy;
• failure to satisfy identity or age verification requirements;
• submission of false, misleading, fraudulent, or incomplete information;
• failure to provide requested documentation;
• suspected fraud, money laundering, financial crime, or other unlawful conduct;
• suspected intellectual property infringement;
• publication or attempted publication of prohibited content;
• publication of content without valid performer consent;
• publication of content depicting any person under eighteen (18) years of age or otherwise prohibited by applicable law;
• publication of AI-generated, synthetic, manipulated, or deepfake content that violates Platform policies;
• use of the Platform to facilitate illegal activity;
• attempts to circumvent Platform security, moderation systems, payment systems, or verification procedures;
• abuse of other users, moderators, customer support personnel, or Company representatives;
• excessive chargebacks, payment disputes, fraudulent transactions, or abuse of the refund process;
• violation of payment processor requirements, payment card network rules, or applicable industry standards;
• requests or directives from payment processors, financial institutions, regulatory authorities, or law enforcement agencies;
• protection of the Platform, users, or the Company's legal, financial, or business interests;
• technical, operational, security, or compliance reasons; or
• any other reason that Hazy Content LLC reasonably determines may expose the Company, its users, payment processors, or business partners to legal, financial, operational, regulatory, or reputational risk.

Immediate Suspension

Where Hazy Content LLC reasonably believes that immediate action is necessary to protect users, preserve evidence, comply with applicable law, satisfy payment processor requirements, prevent fraud, respond to a security incident, or address suspected illegal activity, the Company may immediately suspend or terminate access to the Platform without prior notice.

Content Removal

Upon suspension or termination, Hazy Content LLC may:

• remove or disable access to any content;
• prevent publication of pending content;
• discontinue subscriptions or monetization features;
• disable messaging or livestream functionality;
• preserve content and account records for legal, compliance, evidentiary, or investigative purposes;
• permanently delete content where appropriate and permitted by law; or
• take any other action reasonably necessary to comply with applicable law or Platform policies.

Content removed from public view may continue to be retained by Hazy Content LLC where necessary for legal compliance, fraud prevention, dispute resolution, payment processor requirements, law enforcement requests, recordkeeping obligations, or legitimate business purposes.

Creator Earnings and Payouts

Termination of a Creator account does not automatically entitle the Creator to immediate payment of outstanding earnings.

Hazy Content LLC may delay, withhold, offset, reverse, or permanently deny payouts, to the extent permitted by applicable law and the Creator Agreement, where:

• chargebacks or payment disputes remain pending;
• fraud investigations are ongoing;
• verification requirements remain incomplete;
• tax documentation is incomplete or inaccurate;
• the Creator has violated these Terms or other Platform policies;
• payment processor requirements require a reserve or hold;
• the Company is required by law to withhold funds; or
• other legal, contractual, or compliance obligations exist.

Any payout ultimately determined to be payable shall be processed in accordance with the Creator Agreement and applicable payment processor requirements.

Subscriber Accounts

Termination of a subscriber account may immediately terminate access to active subscriptions, purchased content, messaging features, and other Platform services.

Except where required by applicable law or expressly provided in the Refund Policy, termination of an account does not entitle a subscriber to any refund, credit, or reimbursement for previously completed transactions.

Appeals

Where applicable under the Appeals Policy or Complaints & Content Removal Policy, users may request review of certain moderation decisions, content removals, or account enforcement actions.

Submission of an appeal does not guarantee reinstatement of an account, restoration of content, reversal of an enforcement decision, or payment of withheld funds.

Hazy Content LLC reserves the right to deny any appeal where continued suspension or termination is reasonably necessary to protect users, comply with applicable law, satisfy payment processor requirements, preserve evidence, or protect the integrity of the Platform.

Effect of Termination

Upon termination of an account:

• all licenses granted to the user to access or use the Platform immediately terminate;
• the user's right to publish, access, distribute, or monetize content through the Platform immediately ceases, except where continued access is required by applicable law;
• Hazy Content LLC may revoke access credentials and disable all Platform functionality associated with the account;
• the user remains responsible for all obligations incurred before termination, including payment obligations, indemnification obligations, confidentiality obligations, recordkeeping obligations, tax obligations, and compliance obligations; and
• termination shall not affect any rights, obligations, liabilities, or remedies that accrued before termination.

Cooperation with Authorities

Hazy Content LLC reserves the right to preserve evidence and cooperate fully with payment processors, financial institutions, regulatory agencies, governmental authorities, and law enforcement agencies regarding any account suspension, content removal, fraud investigation, intellectual property dispute, suspected illegal activity, or other matter requiring investigation.

Nothing in these Terms shall require Hazy Content LLC to provide advance notice where doing so would interfere with an investigation or violate applicable law.

Survival

Termination of an account or these Terms shall not affect any provision that by its nature is intended to survive termination, including, without limitation:

• payment obligations;
• creator payout provisions;
• recordkeeping obligations;
• privacy obligations;
• indemnification;
• disclaimer of warranties;
• limitation of liability;
• arbitration;
• class action waiver;
• governing law;
• compliance obligations;
• audit rights;
• and any other provision intended to survive termination.

The rights and remedies available to Hazy Content LLC under these Terms are cumulative and may be exercised individually or together. Failure by Hazy Content LLC to enforce any provision of these Terms shall not constitute a waiver of any right or remedy.
